Terms of Service
By ordering a web site from Grassfrog Technologies LLC, you agree to the following terms of service.

The pricing and content listed here is available only to home inspectors. NACHI membership is not required to purchase a website through is, however non-members are ineligible to use NACHI specific web site content and have different design templates available to them since some of our templates are built with the NACHI Logo on them.

We offer web sites on a month-to-month or annual basis with no long term commitment or obligation.

To cancel your hosting subscription at any time, simply visit www.PayPal.com (if you have a PayPal subscription) or contact us if you are on a direct billing plan. When we receive notification that you have cancelled your hosting subscription was cancelled, we will then terminate your hosting account. Please note that we do not offer credit for partial months or years on prepaid hosting accounts, except in the case of annual hosting renewals when the customer contacts us within 15 days of their annual renewal (in which case their hosting would be prorated at the rate of $1.50 per day from the date of cancellation and a $25 administration fee will be assessed).
- If a website is cancelled before it is created, the same $25 administrative fee is assessed for cancellation. If a website is cancelled after it is created, buyer is not eligible for any refund of setup fees, or prorated hosting fees for unused hosting time.
- If at any time your subscription payment does not go through, we will notify you once via email and give you 3 days to respond and remedy with payment. During this period, your domain will be deactivated. If payment is not rendered within that 7 day period, your account will be terminated. If your account is terminated by PayPal and you need to resubscribe, an administrative fee will be assessed, and you will be subject to resubscribe at current hosting rates. The administrative fee can be waived if the hosting account is renewed as an annual subscription.
- If your credit card payment fails multiple times on a hosting plan, we will contact you via email to resolve the payment issue. Since our merchant bank charges us for payment failures, we pass these along to the cardholder, either as a single administrative fee ($25) or a fee per occurence (not to exceed $5 per failure), whichever is greater.
- URLs for terminated or cancelled accounts are set to forward to our main site address. If you do not want your URL to go there, it is your responsibility to move your DNS servers to another host provider, or to remove your DNS settings.
- Domain specific email accounts are available upon request. Email accounts are alias based, which means they simply forward to your primary email account and are not set up for email sending. You may also opt to purchase email from your registrar, in which case you may order email setup from us for a nominal fee, and send us your MX/CNAME settings so we can change your DNS records to facilitate use of an outside email provider.
- Web site owners are prohibited from posting illegal or objectionable content on their web site, including but not limited to racist or hate-based content, pornography or libel. Email account holders are subject to standard anti-spam protocol. We take spam complaints very seriously and reserve the right to terminate your email account at any time for spam violations.
- All hosted web sites require a link back to our web site and have our copyright footer on them. If you would like to order a web site without our copyright footer, contact us for special pricing.
- If you request that we register a domain name for you, we will so, under our own company account. While we register domains under our own account, you are welcome to transfer your registration at any time while your account is active with us, by simply requesting a transfer through the registrar of your choice.
- Domain registration is done on an annual basis. When your domain registration becomes due, we will notify you. If you do not renew your domain name, either through us or by transferring the name to your own registrar account, we will, at our option, either renew the name at our own cost (thus assuming ownership of the same), or let the name expire. You agree to hold us harmless for actions taken with regards to domain name registration and ownership.
- While we register domains for our clients as a convenience for them, we recognize that we are not in the primary business of domain registration. All domains we register are under our name, in trust for our clients, and may be transferred to your own account at any time as long as your domain is still active. To transfer your domain, simply select an registrar and initiate a transfer request. When we receive this request from the registrar, we will confirm it with you and then approve it with the registrar. To speed up this request, simply email us at the same time you initiate the transfer.
- Unless you hire us separately to backup your web site and database, you agree to take all responsibility to keep a backup of their web site images and content on your local computers. In the event of a server crash or other unforeseen issue, it is our responsibility to restore the web site shell with standard content, and it is your responsibility to restore your specific web site content.
- All hosting accounts come with specific storage and bandwidth limitations. Sites which exceed their bandwidth limitations in an given month will be temporarily suspended until the following month and assessed a $20 fee for exceeding their traffic quota. This fee may be assessed in every month that traffic bandwidth is exceeeded, and does not apply to bandwidth expansion. In the event of traffic overflow, site owners will be notified and given the opportunity to upgrade their bandwidth. Use of external traffic generation software intended simply to generate artificial traffic to your website is prohibited and may be grounds for suspension and/or termination.
- You agree to limit our liability for any interruptions of service, whether due to technical issues or any other reason, to actual downtime in excess of 72 hours, expressed in real value at our standard hosting rates. The 72 hour limit does not apply in the case of natural disasters, acts of God or national emergencies. Furthermore, all clients agree to initiate and handle any litigation within the jurisdiction of the county of Boulder, state of Colorado.

Technical support, including training, on your web site is available on a fee basis. To order technical support in 15 minute increments, please visit our support area. We issue refunds and/or vouchers for tech support time that is ordered but not used. Support vouchers expire within 6 months or at the end of the calendar year in which they are issued (whichever comes first). Technical support that is provided without pre-payment will be billed upon delivery, with payment due within 48 hours. Site owners with outstanding bills for technical support provided may be subject to website suspension until the outstanding balance is paid or deducted from your hosting balance.

We reserve the right to terminate your hosting account for any reason. Most commonly, this right would be exercised in the case of a TOS violation (email abuse, posting of illegal or offensive content on your web site), or for accounts in arrears. Accounts cancelled by client, or by us due to TOS violations, are not eligible for refunds of hosting or other fees.

In the event that any of our terms of service change, they will be posted on this page. It is your responsibility to check back on this page periodically for updates to our terms and conditions of service.

By signing up for a website, you explicitly agree to all of the terms and conditions listed herein. If at any time you do not agree to these terms and conditions, it is your responsibility to cancel your existing subscription, by visiting www.PayPal.com, or contacting us if you are on a direct billing plan.
- Notwithstanding the foregoing limitations, in no event will the total, cumulative liability of Grassfrog Technologies LLC for damages under this Agreement exceed one hundred dollars U.S. (US $100.00).
